The $100,000 Winning Colours® Stain Remover Sweepstakes ("Sweepstakes") will begin at 12:00 a.m. Eastern Time ("ET") on March 21, 2009 and end at 11:59:59 p.m. ET on November 22, 2009 ("Promotion Period"). Participation in the Sweepstakes constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to the Sweepstakes. The Sweepstakes is sponsored by Niagara Mist Marketing Ltd., 11 Victoria Street, Suite 220A, Barrie, Ontario, Canada L4N 6T3.
Eligibility: The Sweepstakes is open to individuals 18 years of age or older who are legal residents of the United States (except in the states of New York and Florida, where it is void) and Canada (except in the province of Quebec, where it is void). The Sweepstakes is also void wherever else prohibited or restricted by law. All members of the armed forces of the USA and Canada stationed outside of the USA and Canada are eligible to enter these sweepstakes. If an entrant is a resident of a jurisdiction that deems him/her to be a minor (residents of Alabama or Nebraska under 19 years of age or residents of Pennsylvania or Mississippi who are under 21 years of age), he/she should obtain parental/legal guardian consent prior to entering or submitting any personally identifiable information.
Employees, officers and representatives of Niagara Mist Marketing Ltd. ("Sponsor"), and any of their respective parent companies, affiliates, franchisees, licensees, distributors, suppliers, subsidiaries, retailers, advertising/promotion agencies, and Alliance Sweepstakes Services, Inc. ("Administrator") (collectively, "Released Parties") and members of the immediate family (defined as mother, father, brothers, sisters, sons, daughters and spouse, regardless of where they reside) and household members of each such employee, whether or not related, are not eligible to participate. To Enter. There are two (2) ways to enter: 1) Purchase a Winning Colours Stain Remover product at any participating retail location in the USA or Canada between 12:00 a.m. Eastern Time ("ET") on March 21, 2009 and 11:59:59 p.m. ET on November 22, 2009. Retain the proof of purchase (original cash register receipt, no reproductions) and CIRCLE the amount that pertains to your purchase. Mail this receipt with your name, valid address, city, state or province, zip code or postal code, and daytime and evening telephone numbers on a sheet of paper and mail it to: $100,000 Winning Colours Stain Remover Sweepstakes, 90 Rockwood Place, Rochester, NY 14610. One submission per person, per mailing address, per envelope. Entries must be postmarked by November 23, 2009 and received by November 28, 2009. 2) To enter this sweepstakes without a purchase, hand print your name, address, city, state or province, zip code or postal code, and daytime and evening telephone numbers on a 3" x 5" piece of paper. On the reverse side of the 3" x 5" paper, hand print "$100,000 Winning Colours Stain Remover Sweepstakes" and a proposed use for Winning Colours Stain Remover. If submitting more than one entry in this manner, the proposed use of Winning Colours Stain Remover must be different on each separate entry. Mail your Sweepstakes entry in a hand-addressed, stamped envelope to $100,000 Winning Colours Stain Remover Sweepstakes, 90 Rockwood Place, Rochester, NY 14610. One submission per name, mailing address and envelope. Entries must be postmarked by November 22, 2009 and received by November 28, 2009.
All entries, or requests of entries, become the property of the Sponsor and will not be acknowledged or returned. Sponsor reserves the right, in its sole discretion, to void any and all entries of an entrant that submits more than the stated maximum limit of entries by using multiple/different identities, registrations and logins, or any other methods, or whom Sponsor believes has attempted to tamper with, influence or impair the administration, security, fairness, integrity or proper play or operation of this Sweepstakes. Sponsor is not responsible for lost, late, damaged, incorrect, incomplete, invalid, illegible, misdirected, or postage-due entries, which will be disqualified. Proof of sending or submission will not be deemed to be proof of receipt by Sponsor. Use of any automated system to submit entries is prohibited and will result in disqualification of all such entries or requests, as well as the entrant. By participating in this Sweepstakes, entrants agree to be bound by these Official Rules and the decisions of the Administrator which are final and binding in all matters relating to the Sweepstakes.
Prizes: One (1) Grand Prize winner will receive $3,000 Cash and a chance to win $100,000. The Grand Prize winner will participate in a chance-based game to determine if he/she will win the additional $100,000 cash award. The Grand Prize winner will be invited to select and remove two (2) envelopes from fifteen (15) sealed envelopes. Two of these 15 (fifteen) envelopes will contain a certificate for $100,000. In order to win the $100,000 cash prize, both winning envelopes must be selected. The winning envelope(s) will be revealed if not selected by the winner of the Grand Prize. The odds of winning the additional $100,000 are 1 in 105.
Drawing and Notification: The Grand Prize winner will be randomly selected from among all eligible entries received, on or about December 14, 2009 or within a reasonable time thereafter. The draw will be conducted in Rochester, NY by Alliance Sweepstakes Services, Inc., an independent judging organization, whose decisions are final in all matters relating to this Sweepstakes. Odds of winning will depend on the total number of eligible entries received. The winner will be notified by telephone and/or U.S. mail, or other home-delivery service of Sponsor’s choice.
Prize Conditions: Upon initial notification and verification of the Grand Prize winner, confirmation will be sent to the Grand Prize winner via telephone and/or U.S. mail, or other home-delivery service of Sponsor’s choice. The Grand Prize winner will be required to sign an Affidavit of Eligibility and Liability Publicity Release and return it within 14 (fourteen) business days of written notification by mail or prize may be forfeited and an alternate potential Grand Prize winner selected, time-permitting. If the prize or prize notification is returned as unclaimed or undeliverable to a potential winner, if potential winner cannot be reached within three (3) business days from the first notification attempt, if potential winner fails to return requisite document within the specified time period, and/or if a potential winner is not in compliance with these Official Rules, then such person shall be disqualified and, at Sponsor’s sole discretion, an alternate potential winner may be selected, at random from all eligible entries received, for the prize at issue. All potential winners are subject to all eligibility requirements in these Official Rules and to verification before any prize will be awarded. If a resident of Canada wins the Grand Prize they will be required to answer, unaided, a mathematical skill-testing question.
Release. By accepting one of the aforementioned prizes, each prize winner agrees to release the Released Parties from any and all liability whatsoever for any injuries, losses, or damages of any kind whatsoever caused by entering the promotion or for damages of any kind whatsoever caused by any prize or resulting from acceptance, possession, or use/misuse of prize awarded, or while preparing for, participating in, and/or traveling to and from any prize-related activity. All prize winners are solely responsible for all applicable federal, state or provincial, and local taxes associated with the receipt of any prize. The Sponsor reserves the right at its sole discretion to substitute any prize package with another prize of equal or greater value in the event that the prize (or any component thereof) is not available. No substitution or transfer of a prize or election of cash in lieu of a prize will be permitted unless previously specified.
Other Terms & Conditions: The Sweepstakes is subject to all applicable federal, state or provincial, and local laws. If the Grand Prize winner is a resident of the U.S.A., a Form 1099 will be issued to him/her for the approximate retail value of the respective prize. Disputes.
